Bad Check

The County Attorney’s Office is responsible for prosecuting persons who write bad checks.

Persons wanting to seek restitution or prosecution should follow these steps:

  • Complete a Protest Form. See link on this page to download the form. (Click Here For Form).
  • Submit a copy of the bad check(s) received along with documentation of any bank charges incurred.
  • State law requires a processing fee of $10.00 per check.
  • Upon receipt of the bad check(s), documentation of bank charges and appropriate fee, a statutory letter will be sent to the bad check signor. The letter will advise the signor that a criminal complaint will be filed against him or her unless full restitution is made within ten (10) days of the date of the letter. 
  • If a bad check writer fails to make restitution, a criminal complaint will be filed in Cheyenne County Court and the signor is notified of the court appearance date.
  • Issuing a bad check of $1,500.00 or more is considered a felony. 
  • Restitution payments are disbursed once a month.
